How Article 81 Appointment Works
Adult Article 81 guardianship is commenced in Supreme Court by an Order to Show Cause and Verified Petition. The court appoints a Court Evaluator to investigate capacity; the alleged incapacitated person has the right to attend and be heard. Incapacity must be proven by clear and convincing evidence — that the person cannot manage their property or personal needs and is likely to suffer harm as a result.
Powers granted must be the least restrictive intervention tailored to actual needs. Once appointed, a guardian files an initial report within 90 days, then annual reports, and must visit the person at least four times per year.
